End User Licence Agreement

This End User Licence Agreement ("EULA") is a legal agreement between you and TimeToTest CIC, a Community Interest Company limited by guarantee, registered in England and Wales under company number 17163328. It governs your use of the TimeToTest mobile application (the "App") and the associated services at timetotest.app. This public EULA mirrors the agreement you accept inside the App.

Before you continue. TimeToTest is an anonymous STI partner notification service. By tapping "I agree" in the App, or by using the App or services, you confirm each of the points below.

1. You must be 18 or older

TimeToTest is for adults only. You must be 18 years of age or older to download, install or use the App. If you are under 18, you must not use the App. We do not knowingly permit anyone under 18 to use the service.

2. What you agree when you use the App

By using the App, you confirm that:

  • You are 18 years of age or older.
  • You will only send notifications to people you have an actual reason to believe may have been exposed to an STI based on your own test result.
  • TimeToTest uses a fixed anonymous SMS. You cannot write or edit the message yourself.
  • You will not send false, malicious, harassing or abusive notifications. Doing so is strictly prohibited and is a misuse of this service.
  • You agree to this EULA and to the Privacy Policy.

3. Zero tolerance for abuse

We operate a zero-tolerance policy for objectionable content and abusive behaviour, including harassment, false notifications and coercion.

You must not use the App or its services to:

  • send notifications you know to be false or that are not based on a real exposure to an STI;
  • harass, threaten, intimidate, stalk or coerce any person;
  • impersonate another person or misrepresent your relationship with a recipient;
  • send notifications to phone numbers that do not belong to individuals you have had a sexual encounter with;
  • attempt to circumvent rate limits, the blocklist or other anti-abuse controls;
  • use the App for any unlawful purpose.

4. Consequences of misuse

If we determine, on the balance of evidence available to us, that the App has been used in breach of this EULA, we may take any of the following steps without notice:

  • Permanently block the device used to send the offending notifications from accessing the service. The App uses a random device identifier for this purpose.
  • Add the recipient's phone number to the permanent blocklist so the App never contacts that number again.
  • Preserve logs and metadata relating to the misuse for use in investigations.
  • Refer the matter to law enforcement or other competent authorities where conduct may amount to harassment, malicious communications or any other criminal offence.
  • Cooperate with lawful requests from the police, courts or regulators.

All reports of misuse are reviewed and acted upon. Our target response time for reports is 24 hours. You can report misuse at /report.

5. Licence

Subject to this EULA, TimeToTest CIC grants you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the App on a device you own or control, solely for the purpose for which it is intended. This licence does not include any right to copy, modify, reverse-engineer, resell, sublicense or commercially exploit the App.

6. No medical advice

TimeToTest is not a medical device and does not provide medical advice, diagnosis or treatment. The App is a communication tool that directs recipients to NHS sexual health services. If you need medical advice, please consult a qualified healthcare professional or contact your local sexual health clinic.

7. Availability and changes

We may update the App, change or withdraw features, or suspend the service where reasonably necessary, including for maintenance, security, legal or safety reasons. We may also update this EULA; if we do, we will post the updated version at this URL with a new "Last updated" date. Continued use of the App after changes constitutes acceptance of the updated EULA.

8. Privacy

Your use of the App is subject to our Privacy Policy, which describes what personal data we process, the retention periods that apply and your rights under UK GDPR.

9. App Store terms

If you download the App from the Apple App Store or Google Play, you also agree to the applicable Apple Media Services Terms and Conditions or Google Play Terms of Service. To the extent those terms conflict with this EULA in a way relevant to your use of the App, those store terms prevail in respect of your relationship with the store operator, but this EULA continues to govern your relationship with TimeToTest CIC.

10. Disclaimer and limitation of liability

The App is provided "as is" and "as available". To the fullest extent permitted by law, TimeToTest CIC excludes all implied warranties, conditions and other terms that might otherwise apply to the App or any content on it. TimeToTest CIC will not be liable for any loss or damage that was not foreseeable, any loss or damage not caused by our breach, or any business loss.

Nothing in this EULA limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

11. Termination

You may stop using the App at any time and uninstall it from your device. We may terminate your licence to use the App immediately if you breach this EULA. On termination, the rights granted to you under this EULA end, but clauses that by their nature should survive (including sections 3, 4, 6, 10, 12 and 13) will continue to apply.

12. Governing law and jurisdiction

This EULA and any dispute or claim arising out of or in connection with it (including non-contractual disputes or claims) are governed by the laws of England and Wales. You and we each agree to the exclusive jurisdiction of the courts of England and Wales in relation to any such dispute or claim, except that, if you are a consumer resident in Scotland or Northern Ireland, you may bring proceedings in the courts of the part of the United Kingdom in which you reside.
